RE: The tariff classification of a polyester/spandex warp knit fabric from China

Dear Mr. Harris:

In your letter dated September 16, 2016, you requested a tariff classification ruling on behalf of your client, Global Textile Alliance, Inc. A sample was provided.

Style 70117 Natural White LW is a white fabric of warp knit construction. According to the information provided, the fabric is composed of 82% polyester and 18% spandex yarns, and weighs 185 g/m2. Your correspondence indicates that the fabric will be imported in widths of 230 centimenters.

The applicable subheading for Style 70117 Natural White LW will be 6004.10.0025, Harmonized Tariff Schedule of the United States (HTSUS), which provides for knitted or crocheted fabrics of a width exceeding 30 cm, containing by weight 5 percent or more of elastomeric yarn or rubber thread, other than those of heading 6001: containing by weight 5 percent or more of elastomeric yarn but not containing rubber thread: warp knit: other. The rate of duty will be 12.3 percent ad valorem.

This ruling is being issued under the assumption that the subject goods, in their condition as imported into the United States, conform to the facts and the description as set forth both in the ruling request and in this ruling.  In the event that the facts or merchandise are modified in any way, you should bring this to the attention of Customs and you should resubmit for a new ruling in accordance with 19 CFR 177.2.  You should also be aware that the material facts described in the foregoing ruling may be subject to periodic verification by Customs. 

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
